1. Agreement to Terms
By accessing or using DaVinChess — including our website and our iOS and Android mobile apps (together, the "Services") — you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Services.
2. Description of Service
DaVinChess is a platform that provides chess training, including personalized repertoire building, spaced-repetition practice, blunder and mate drills, endgame training, and educational content, available on the web and through our mobile apps. We offer both free and paid subscription tiers.
3. Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Be old enough to use the Services (at least 16, or the minimum age in your country)
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activity under your account
4. Subscriptions and Payments
Plans and pricing: We offer a free tier and one or more paid subscription tiers. The current plans, prices, currencies, and billing periods are shown at the point of purchase — at checkout on our website and on the subscription screen in the App Store or Google Play. By subscribing, you authorize the applicable charge for the plan you select.
Where you buy matters: Subscriptions purchased on our website are billed through Stripe. Subscriptions purchased inside our iOS app are billed by Apple through your App Store account, and subscriptions purchased inside our Android app are billed by Google through your Google Play account.
Auto-renewal: Paid subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. For mobile purchases, your store account is charged for renewal within the 24-hour window before the period ends, in accordance with Apple's and Google's terms.
Managing and cancelling: You can cancel a web subscription from your account dashboard; access continues until the end of the current billing period. For mobile subscriptions, you manage and cancel through your Apple App Store or Google Play account settings — we cannot cancel a store-billed subscription on your behalf.
Refunds: For web subscriptions, we consider refund requests on a case-by-case basis within 14 days of purchase — contact us. For purchases made through the App Store or Google Play, refunds are handled by Apple or Google under their respective policies, and you should request them through that store.
5. Acceptable Use
You agree not to:
- Use the Services for any illegal purpose
- Share your account with others
- Attempt to reverse engineer or copy our software
- Scrape or collect data from our platform
- Interfere with the proper functioning of the Services
6. Intellectual Property
All content, features, and functionality of DaVinChess—including but not limited to text, graphics, logos, and software—are owned by Rozek Industries Ltd (trading as DaVinChess) and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our permission.
7. User Content
You retain ownership of any content you create or submit (such as custom repertoires, uploaded games, and feedback). By using the Services, you grant us a license to use this content to provide, support, and improve the Services.
8. Disclaimer of Warranties
DaVinChess is provided "as is" without warranties of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or meet your specific requirements. We are not responsible for your chess rating or performance in games.
9. Limitation of Liability
To the maximum extent permitted by law, DaVinChess shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.
10. Account Deletion and Data
Deletion: You may delete your account at any time from Account Settings on the web or from your app settings. Upon requesting deletion, your data is marked for removal immediately and permanently deleted after a 30-day grace period, during which you may cancel the deletion and restore your account. Data Export: Before deleting your account, you may export all your personal data (games, training sessions, repertoire, and statistics) in JSON format from Account Settings.
What is deleted: All PGN uploads, games, repertoire data, training sessions, training attempts, opening lines, and training statistics. Audit logs may be retained for up to 1 year for compliance. Payment records are retained by Stripe, Apple, or Google per their data-retention policies.
11. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these terms. Upon termination, your right to use the Services will cease immediately.
12. App Stores (Apple and Google)
If you obtained our app from the Apple App Store or Google Play, you also agree to that store's terms, and the following apply:
- These Terms are between you and DaVinChess only, not with Apple or Google. DaVinChess, not Apple or Google, is solely responsible for the app and its content.
- Apple and Google have no obligation to provide maintenance or support for the app.
- To the maximum extent permitted by law, Apple and Google have no warranty obligation with respect to the app, and any claims relating to the app are directed to us, not to Apple or Google.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The same applies to Google where required by Google Play's terms.
13. Dispute Resolution
Any disputes arising from these terms or your use of DaVinChess will first be addressed through good-faith negotiation. These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction over any dispute. If you are a consumer, you may also benefit from any mandatory protections of your local law and the right to bring proceedings in the courts of your country of residence.
14. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or through the Services. Continued use after changes constitutes acceptance of the new terms.
